Empowering Migrant Victims of Domestic Abuse

Empowering Migrant Victims of Domestic Abuse with the MVDAC.

Support For Migrant Victims of Domestic Abuse

Migrant victims of domestic abuse in the UK now have access to the Migrant Victims of Domestic Abuse Concession (MVDAC), previously known as the Destitute Domestic Violence Concession (DDVC). This provision allows victims to secure their immigration status independent of their abusive partners.

The victim is granted a three-month period of leave to remain, during which they can work and access public funds. Within this timeframe, they must either apply for an extension of leave through an appropriate route, seek settlement in the UK if eligible under Appendix Victim of Domestic Abuse, or make arrangements to leave the country.

Previously, this concession was limited to victims of domestic abuse in the UK who had partner permission under Appendix FM. It has now been extended to include partners of individuals on work, student, and graduate routes. However, while these applicants are now covered by the concession, they remain ineligible for settlement under Appendix Victim of Domestic Abuse.

Under the new Appendix Victim of Domestic Abuse, applicants can obtain settlement if they currently hold or were last granted permission as a partner on a specified route and the relationship has permanently ended due to domestic abuse. Applications must be submitted from within the UK unless the applicant has been abandoned overseas.
